PREAMBLE

The sales terms and conditions below apply between Just for Elle, the owner and editor of www.beautesecrete.com, herefafter named "Beauté Secrète" and the user and customer of www.beautesecrete.com hereafter named "customer". Any order on www.beautesecrete.com implies the consultation and acceptation of these sales terms and conditions.

Just for Elle is an SARL registered towards "registre du commerce et des sociétés de Versailles" (Versailles registery of Businesses and Companies). Its "SIREN" (Registration Number) is 511 349 961 and its intracommunity VAT Number is FR36511349961. Just for Elle is headquartered at 22, avenue Fernand Lefebvre, 78300 Poissy in France.


1 - Your order

These sales terms and conditions apply as a customer validate its order at Beauté Secrète and remain valid until the end of Beauté Secrète guarantees on the order and the items delivered. As a customer validates its order at Beauté Secrète, he/she accepts these sales terms and conditions, as well as the prices and contents of items and services he/she ordered. In compliance with the article L 121-19 of the French Consumption Code, Beauté Secrète customers will receive by an email or rpinted copy of these Sales Terms and Conditions at latest on their order delivery date.


2 - Product prices, Means of payment and Currencies

In compliance with the Article L. 111-1 of French Consumption Code, Beauté Secrète presents on www.beautesecrete.com products customers can buy with their main characteristics.

Product and services prices

Product and services prices are presented by default in Euros and including France sales tax (=VAT). Prices charged are those indicated as customers checked out and validate their order form.

Should prices be modified after the order form has been validated and sent to Beauté Secrète, the order will not be impacted by the change in prices. The order total amount will remain the amount validated as the order was placed.

Product prices do not take into account delivery fees. An estimate of delivery fees can be calculated on the page "My cart" before checking out. The delivery fees will then be confirmed on the order form, before its final validation.

V.A.T. (Sales tax)

Prices include France V.A.T., based on the V.A.T. rate on the day of the order (currently 19.6%). Should the V.A.T. rate change, prices will be adjusted with the new rate. Customers requesting for a delivery in the European Union will be charged France V.A.T or sales tax by Beauté Secrète in compliance with the European Union rules regarding VAT. Customers requesting for a delivery outisde of the European Union will not be charged France V.A.T. or sales tax.

Currency

Product prices are displayed in Euros. Orders are always charged in Euros and customers have to pay in Euros. Beauté Secrète is not liable for the exchange rate applied by the customer bank. Beauté Secrète is also not liable for potential fees its bank could charge to a customer for a purchase in Euros.

Means of payment

Customers can pay their order at Beauté Secrète using the following means of payments: credit card, debit card, check (issued by French banks only), bank transfer, a Paypal account, or a Beauté Secrète gift certificate code. Customer certifies that he/she is authorized to use the means of payment he/she selected to place its order on Beauté Secrète.

In line with Beauté Secrète policy to fight credit card fraud, Beauté Secrète can ask customers to proove their ID and their address before shipping an order, or to pay through bank transfer. Beauté Secrète can cancel an order in case customers do not accept to provide a proof of their ID and address. In this case Beauté Secrète will also cancel the payment. Beauté Secrète can also cancel orders in the following situations: there exist an unsolved dispute regarding a previous order of the customer, Beauté Secrète's bank does not accept the payment of the order, the order has not been payed.

Should you notice that your Beauté Secrète account has been used by someelse, you have to contact Beauté Secrète Customer Service as soon as possible at customer_service@beautesecrete.com.


3 - Shipping/Delivery information

Where does Beauté Secrète accept to ship?

Beauté Secrète mainly ships to France, the European Union and North America but accepts to ship everywhere. However Beauté Secrète insists on the fact that customers have to check with their local customs whether they would have to pay import taxes, import duties, excise duties, custom taxes and/or custom fees to receive their parcel. More information on this topic is available below.

When will an order be shipped?

Beauté Secrète usually ships in stock items in one or two business days. The delivery date will then depend on the delivery option selected as the customer placed its order (economic delivery or fast delivery). If items not in stock have been ordered, the estimate shipping time of these items is specified on the items description page. Customer have to check those pages to know when their order will be shipped.

About business days: Beauté Secrète is based in France, where Saturdays and Sundays are not considered as business days, as well as the following bank holidays: January 1st, Eastern Monday (in March or April), May 1st, May 8th, Ascent Thursday (in May), Pentecost Monday (in May or June), July 14th, August 15th, November 1st, November 11th, December 25th. Should your orer be shipped outside of France, the delivery date will also depend on your country business days.

How much is charged for shipping and handling?

Handling fees are included in shipping fees. Shipping fees are automatically calculated as a customer checks out, and depend on the weight of your order, the delivery location, and the delivery option selected (economic or fast). Economic delivery fees are about:
- 7 to 9€ for a delivery in France, Monaco and Andora.
- 10 to 18€ for a delivery in France overseas departement and territories.
- 16€ for a delivery in the European Union, Switzerland and Norway.
- 19€ for a delivery in Eastern Europe and North Africa.
- 22€ for a delivery in the rest of Africa, Canada, the USA and the Middle East.
- 24€ for a delivery in the rest of the world.

How much is chargerd for import taxes, import duties, excise duties, custom taxes and/or custom fees?

Customers requesting for a delivery in the European Union will not be charged any import taxes, import duties, excise duties, custom taxes and/or custom fees.

Customers requesting for a delivery outside the European Union may be charged any import taxes, import duties, excise duties, custom taxes and/or custom fees based on their country custom regulations. Beauté Secrète does not collect those fees, duties and taxes, and is not responsible for the amount charged to customers. In many countries, there are treshold of orders under which some fees, duties and taxes are not charged. Gifts can also be submitted to more favorable fees, duties and taxes (also depending on their value). Beauté Secrète strongly advises customers to collect information on import and custom fees, duties and taxes before placing their orders. Beauté Secrète will not lie on custom forms for the benefits of its customers and Beauté Secrète will not refund any orders because import or custom fees, duties or taxes were charged to customers, based on their country import and custom regulations.

Order tracking

Customers receive an email as soon as their order have been shipped by Beauté Secrète. This email contains the name of the carrier and a tracking number. Delivery progress can be tracked on the carrier website using the order tracking number.

What to do in case of troubles with the order delivery

"An item is not available": Beauté Secrète does its best to ensure items availability towards its suppliers. Should an item not be available (temporarily or definitively), Beauté Secrète will inform you as soon as your order has been handled and will propose you several options: waiting for the item availability, opting for another item, canceling your order and receive a coupon with same value as your order, canceling your order and be refund.

"I cannot track my order / My order is late": Please contact Beauté Secrète Customer Service at: customer_service@beautesecrete.com and indicate in your email your name, email, order number and order date. Beauté Secrète will contact the carrier, search for your parcel and keep you informed.

"The parcel I received is abnormal/ has an issue": Should you notice any issue or abnormality on your parcel as you receive it, please indicate it on the delivery form and inform Beauté Secrète Customer Service at customer_service@beautesecrete.com within two business days. Do not forget to specify your name, email (the one used for your order), order number and order date in your email. Beauté Secrète will contact the carrier, try to idenitfy what occured and keep you informed.

"In Case of absolute necessity and Strikes": Should your order be late because of a case of absolute necessity or because of strikes, Beauté Secrète will does its best to minimize the impact on your order delivery. However, in such circumstances, Beauté Secrète is not liable for the delivery delay.


4 - Returns, Exchanges and Refunds

Beauté Secrète considers its customer satisfaction has its top priority. Therefore customers can return unworn items within 7 days following the order delivery date (except for items that have been customized upon customer request).

How do customer proceed to return something?

1/ They have to ensure that the item is unworn, perfectly clean, full, not damaged, with all tags attached and in its packaging. If it is not the case, Beauté Secrète may refuse the return.

2/ They then send an email to Beauté Secrète Customer Service at customer_service@beautesecrete.com and specify:

- their first name, last name, and email address (the one used for the order)
- the order reference number and the order date
- if they wish a refund, a coupon or an exchange
- in case of an exchange, items they wish instead
- the reason why they proceed to a return

3/ Beauté Secrète will confirm to customers by email whether their return is accepted or not.

4/ Customers proceed to the return by sending items to:

Customers have to ensure that you select a trustworthy carrier because your are responsible for the return of items. Beauté Secrète does not refund return costs except if the return is due to an abnormality of the item or to an error in the parcel content.

5/ Beauté Secrète Return Center ensures that the item is unworn, perfectly clean, full, not damaged, with all tags attached and in its packaging.

6/ Beauté Secrète proceeds to the exchange, to the refund or create the coupon.

Please note that:
- the full process should take about 10 business days.
- Beauté Secrète will not charge shipping costs in case of an exchange.
- In case of a refund, initial shipping costs are not refundable.
- In case of abusive returns, Beauté Secrète may refuse your next order.


5 - Products guaranties

In compliance with French Regulations ("code de la consommation" and "code civil"), customers can return damaged items to Beauté Secrète within two months after the order delivery date. This gaurantee includes only items that have been used normally and does not include items damaged by the customer because of abnormal use. To take benefits of this guarantee, customers have to proceed as explained in the Article 4 of these sales terms and conditions.

Beauté Secrète does produce the items sold on www.beautesecrete.com, therefore Beauté Secrète cannot be held responsible for any damages caused by an item bought on its website.


6 - Privacy Policy

At Beauté Secrète we are committed to protecting customer privacy, therefore:

1/ Information collected while customers browse our website and place orders is used only to handle orders and their delivery, to manage customer accounts and to enhance our website and our services.

2/ Beauté Secrète does not collect nor save any information regarding credit or debit cards, as customers are redicted to our bank website where the full payment process is completed and fully secured.

3/ Beauté Secrète complies with France and the European Union Regulations regarding Privacy Data Protection. According to these regulations, any user of www.beautsecrete.com can access to the data we collected about him/her and request for their modification or refuse their handling. To do so, customers have to contact us at via email at contact@beautesecrete.com or write to Beauté Secrète - 22, avenue Fernand Lefebvre - 78300 Poissy - France.

4/ Customers can easily unsuscribe from our newsletter by logging to their Beauté Secrète account and modifying their options. Customers can also clic on the "unsuscribe" link at the bottom of our newsletter, or send an email to our Customer Service at customer_service@beautesecrete.com.

5/ Beauté Secrète complies with French 06/01/1978 legislation and www.beautesecrete.com is registered towards CNIL, the "Commission Nationale Informatique et Liberté" (France Board which enforces law on Data Protection).


7 - Copyrights, Intellectual property

Any contents of the web site www.beautesecrete.com are protected as stipulated in France Regulations. They belong to Beauté Secrète, to its suppliers and to its business partners. Any copies are strictly forbidden and can lead to prosecutions, except for printing these sales terms and conditions or printing a product comparison chart for personal use.

Should a customer or somebody else wish to place a link from its website to www.beautesecrete.com should first ask Beauté Secrète for authorization and should remove this link if Beauté Secrète requests so. In any cases, framing linking, in-line linking and deep linking are strictly forbidden.


8 - Liability

Beauté Secrète is responsible for the proper handling and delivery of any orders placed on www.beautesecrete.com. However Beauté Secrète will not be liable in case Beauté Secrète prooves that the order management and delivery was not properly achieved because of either the customer, or a service provider (for an non foreseeable reason) or a event beyond reasonable control.

Beauté Secrète cannot also be held responsible for any damages due to the use of Internet, including among other things, Internet service breakdown, computer virus or external intrusion.

In case www.beautesecrete.com contains links to other websites, Beauté Secrète cannot be held responsible for the content of websites should they not respect legislation and regulations.


9 - Governing law and jurisdiction

These conditions are governed by and construed in accordance with the laws of France. You agree, as we do, to submit to the non-exclusive jurisdiction of the French courts. Your statutory rights are not affected by these terms and conditions.


10 - Validity, modification and update of these sales terms and conditions

These sales terms and conditions apply from their day of publication on this website (as specified on top of this page) until the day of publication of an updated version. These sales terms and conditions can be modified without prior notice to take into account changes in regulations or changes in Beauté Secrète Sales Policy.
